Neighbor"s Information Request

Our Homeowners Association recently replaced an old wood fence, with a concrete block fence, on top of the original concrete block foundation. In other words, there was no change in the location or foundation of the fence. Our complex is over 30 years old. A licensed contractor completed the work.

The homeowner of the property (home is less than 2 years old) adjacent to the fence has approached us with an interesting request which prompted my question. He says that he is updating his homeowners insurance. He says he needs a copy of the city permit and the surveyors report required to replace the fence. He states this information is required by his insurance company.

Questions: Are we under any obligation to supply this information? Would an insurance company require this information since it is not his property? We have never heard of such a request.

The neighbor's insurance may want to be sure the fence is not a danger to their insureds property. Although it sounds as if they may just have a problem with the fence and are using this as a ruse to get the info.

How are you involved in this?
Tell the neighbor to call the building dept. of whatever concerned municipality to get needed copies. That's where they came from and it's public record.

He can get copies of the permits from the city's planning/permits office for a minimum charge, even though the fence is replaced on top of the original foundation with a more substantial fence, it still requires permits, the HOA/contractor did obtain proper permits and inspections? The HOA should still have copies of the most recent survey, this will determin if the placement is on the property line or not. Why would insurance want this information? If it is on the property line then both parties have joint responsibility for it, this is called a good neighbor fence. A cinderblock fence may change the rate of insurance because it is less likely to be burned, attract termites, be affected by weather and deters fence jumpers and the like. Now if the fence is on their property, then it will have to be moved that is why a survey needed to be made or confirmed and permitted before construction.

Also such a fence could alter drainage and water damage.

Thank you for your responses! I am an Association officer and believe we have met all city permitting requirements. Has anyone ever heard of an insurance company making this sort of request?
