Neighbors Dangerous Damaged Tree

What is the name of your state? md

my neighbor has a 40 foot tree that has been damaged and is now leaning on another tree. it is only a matter of time before it falls and crashes through my fence. how can i ensure that he should pay for the damages if this happens or make him remove the tree. i have contacted him about removing the tree already to no avail. i dont want my insurance to be liable or myself for his neglect.

**A: when you called your insurance carrier, did they tell you to send a certified rrr letter demanding mitigation or be subject to any and all liability?

Since there is no damage yet, "tree still hasnt fallen" I havent contacted my insurance. Someone else also said I should send him a certified letter though..... Should I contact my insurance and let them in on this, even though there is no damage yet?

I have a similar situation with an uncooperative neighbor and I would be curious as to who is legally responsible for the removal of the tree. What did you discover?

Send the neighbor a very nice letter (certified RRR) advising them of the condition of the tree and the potential for damage if it were to fall. Include that he would be liable for any costs or damages caused by the tree.

Also, take pictures of the trees condition.

As for who pays.... the owner of the tree.
