I am a tenant in Marin, California. A large tree belonging to the owner of the neighboring apartment complex has fallen in my yard. Both parties' insurers claim this is an "act of God" so they don't have to pay for tree removal or debris cleanup or property damage (minor damage to building; my plants, planter boxes & yard furniture are trashed). Tree owner also claiming that he's not responsible. Who is responsible? Do I have to clean up & dispose of the debris (there's a lot of it - it is a very large tree) and the broken furniture?
