Hello, this may seem completely silly, but I want to know if I would have any chance in court if it came down to it...
I have lived in my apartment building for almost two years. About 7 months ago some new people moved in and our kitchens share a wall. Everything was fine up until a few months ago. They started having a lot of parties, which would be fine if they were doing this on the weekends...but they have them in the middle of the week and they can last until the wee hours. My roommate and I both go to school full-time and work 30+ hours each during the week. We rarely have company and are probably the most considerate people in the building. Last week my noisy neighbors had parties on Saturday, Monday, Tuesday, and Wednesday nights. Saturday was not a big deal. The three nights in a row on the weekend were.
The hallway in our building has a bad echo and if anything is going on out there it can be heard in any given apartment. Well, my neighbors have a bad habit of leaving their apartment door ajar as people are going in and out of the party which sends all of the noise out into the hallway, and thus, into my apartment. It does not help that their party guests yell and scream while in the hallway at 2am... On the Monday, Tuesday, and Wednesday nights when they had parties I walked down the hall and asked them nicely if they could at least make sure the door stayed shut because of the acoustics in the hallway. My requests were pretty much ignored. I resorted to yelling into the hall after awhile during some of the more obnoxious singalongs going on well after midnight. I should mention that I have had to ask them to keep it down on several other occasions, but it has recently gotten worse.
Sunday night they had another party. I had a migraine, I couldnt sleep, and they were not helping. I did not ask them to keep it down, but waited until almost 1am before I just couldn't take it anymore. I called my local police department with a noise complaint so they would come break up the party. I live in a very 'college' kind of area, so the police usually just come break it up and they don't bother anyone as long as they comply. Since they spoke to my neighbor in the hallway I could hear everything. They were nicer than most officers in our area. Nobody got in trouble...the party was dispersed...and all was quiet.
Until today...Thursday. I received a notice from our property manager that noise complaints had been filed on MY apartment the day after I had called the police on my neighbors. I have lived here for almost two years and have NEVER had a problem with a neighbor. We are the quietest people EVER. I am quite sure that they made a false complaint out of spite and only did it to be vindictive and malicious. I am making an appointment to speak with my property manager tomorrow to discuss all of this because we have been falsely accused of violating our lease agreement.
I work with a division of the police department and am therefore a representative of the department. I maintain an impeccable record in all aspects of my life and am very upset by this immature action. If I wanted to be a mean and spiteful neighbor I could have had them evicted a very long time ago if I had filed a complaint every single time they were disruptive to everyone else in the building.
If my property manager is unwilling to see my side of things and remove the complaint from my file would I actually be able to sue my neighbors? This has caused me an immense amount of stress and anger because this is actually something that affects my record as a tenant and, should they choose to file more false complaints, could eventually have terrible consequences for us. Should these kinds of poor marks on my record get back to my employers it could affect my position under the police department. What should I do if it comes down to it?
