What is the name of your state?Pennsylvania

My neighbors garage burned melting our pool causing about $2000 in damage. His insurer said he is not liable because he was not negligent. Is this true or a ruse to avoid paying? My insurance may pay but I have a $1200 deductible and I am not excited about adding claims to my history to raise my rates. I understand this may fall into the small claims category, but would like to deal with the Insurer if that is a viable alternative. Please advise.

Insurance companies only pay if there is "negligence" attaching to their insured.

Does that mean I have no option but to sue? And if so is that worth it or will I likely loose due to no negligence, or win due to IT WAS THEIR STUPID FIRE! (sorry kinda tired here.)
