Neighbor’s property liability insurance ?

Hello,
My mother in law lives in a townhouse which shares a wall with the neighbor’s unit. The neighbor’s washing machine connection came loose and dripped water in the wall for a long time and damaged our wall and grew mold. The neighbor is not cooperating or talking to us and she has damage as well. We do know she had property insurance and they sent out a remediation company to look at her damage and came over to see the leak from the hole in our wall. We do not have any property insurance. Question: if she has liability insurance with her home owners policy, don’t hey have to pay for our damage? She is not talking to us so we don’t know who he insurance is or if she has liability coverage. We are going to fix the damage in our place but how can we find out about her insurance if she won’t talk to us?

Absence negligence on her part to address the drip AFTER it was discovered, I doubt your MIL has a viable clam

Your mother-in-law should file a claim with the neighbor's insurer/the neighbor. She would be smart to get repair estimates now - and, if warranted, she should repair the damage to keep it from getting worse. She will want to keep all written estimates and repair receipts to support her claim.

Not unless the neighbor was negligent. And, frankly, I don't see any negligence based on a sudden and unforeseen malfunction.

From a legal standpoint, she has no obligation to talk to you (and is wise not to) and whether or not she has liability insurance is none of your business.

If you believe that she is negligently responsible for the damages, and she won't cooperate, you file a lawsuit.

This does not appear to be a "sudden" malfunction. The drip apparently was left unchecked for a long period of time.

The state name was not provided so if Tkreger wants more specific information, the state name will be needed.
