neighbors sewer line cutting across our property

What is the name of your state?We live in Michigan. We are going to build a new garage in our back yard. Doing some preliminary checking we find that our neighbors sewer line cuts across our property right where we planned on building our garage. As far a I know there are no easements granted to anyone for this. Our house and the neighbors were built around the 1930's.

Do we have the right to ask the neighbor to move the sewer line at his expense? Thank you...

You certianly are free to ask but dont be surprised if the nieghbor declines , have you called your city public works desk to learn what they have to offer ? fair odds are that the nieghbors sewer pipe being there for so many years now gives them a prescriptive easement through your property. This is a matter that you should also consult with a local real estate atty on. see you might learn for example that your city requires failed lines to be redone to the street that the home faces and if that were the thing then perhaps you can build over the line anyway. You really should consult with a local real estate atty. Try the links up top and see what you learn. LAST thing learn from your water and sewer dept if each of your homes has a tap card on file . Many homes years ago had shared sewer taps.
