I have an easement on my property and the neighbor has
placed a permanent shed structure on the easement. The type
of easement is a right of way. I believe that legally the shed should not be on the right of way ; is this correct? Also, what are the legal ramifications if he, his family, friends or anyone using the shed are injured? Would
I be responsible as I am the property owner. Additionally,he has a gravel driveway on the easement again
would I be responsible if someone from his party was injured? Finally, the neighbor has also used about a quarter
of acre of my property for his own usage and cuts the grass
on it and has bon fires and cars parked on it when he
entertains guests.I know this is encroachment but could I
be held legally responsible if he or his party is injured?
