From Maryland: 100% of my neighbor's tree's branches hang over my yard where I plan to build a garage. The tree will definately die when the branches are cut - and they must go in order to build. I have a permit to build. What is my legal standing if the neighbor refuses to comply with taking down the tree? Can I cut the branches without permission even if the tree will die? I just moved in and the previous owners say the neighbor is unfriendly and difficult. Any advise is greatly appreciated.

Send the jerk a certified letter demandng that the tree be cut by_______date and if it is not cut by that date, you will be forced to cut the tree in order to construct your garage. You will not be liable for tree damage and/or killing the tree as a result.
