I was involved in an auto accident. It was raining hard and really foggy and the car in front of me stopped at a green light. My car hydroplaned and I ended up rearending them. Neither part had automobile insurance. We made an agreement to that I would pay out of pocket for his damages since I rearended him. Yesterday I received a call from a lawyer saying he was representing them. I guess this is an attempt to collect more money by saying there are some personal injuries related to the accident. What rights do I have? Is there any type of clause since it was rainy and he was actually in the wrong by stopping at a green light? Are they liable to pay for the damages to my car? Do I really have to pay since they did not have insurance either at the time of the accident? I do have the funds available to pay for the damages but I do not want to end up getting sued. Thanks in advance for any information provided!

You wish. As a licensed motorist, it is your responsibility to avoid all hazards, legal or not.

From your description, no.

Yes.


I do have the funds available to pay for the damages but I do not want to end up getting sued.

Pay the other party what they want.
