Neoghbors Kid Throwing Rocks at my Dog!

We have lived in our home for almost six years. We have a seven year old female boxer. About 4 months ago new neoghbors moved in with two children. The youngest boy (about 10) teases the dog. We have been watching and hoping the boy would get bored with the dog. Yesterday my husband came home from work and let the dog out. He heard her barking and looked out. The kid was throwing rocks at the dog in my yard. (Rocks just missing our car) My husband went outside saw him throw another rock and yelled at him. He did not curse but was very firm. He never left our yard. At 11:30 last night the cops knock on our door to investigate us threatening their child. Boy are we shocked, what can we do to protect our dog and our property. Oh, and by the way my dog never left my yard!

Question:
Does my dog have any rights?
Is it legal to throw rock onto the property of others?
What are my rights as the property owner?
Can I get a restraining order to keep them off of my property completly?
Did my husband break the law yelling at the child?

No, animals do not have rights; only humans have rights.

Probably not.

What are my rights as the property owner?
Keep your dog inside or on a leash when it goes outside; if the dog bites that kid, you are in a world of hurt. Check with your homeowners insurance to see if you are covered for dog problems.

Can I get a restraining order to keep them off of my property completly?
Go ahead and try it; I don't know if it will work. You could spend thousands of dollars getting an order keeping this kid off the land and then the next day he does the same thing.

Did my husband break the law yelling at the child?
I am not sure; there are not enough facts here.


The legal system is not geared up to cure every possible irritation of life.

Thanks, we did find out we can file a Crimial Trespassing Warrant with a police officer. We will do that tonight. Then we will be able to have them arrested on the spot if they enter our property. I am also looking into filling charges over the rock throwing. The police officer said that isn't legal. He also told me there are laws against cruelty to animals so I am looking there. Let me know if anyone knows where to start. Thank again!

or "duh" like..I don't know...how about put the camera someplace they couldn't get at it.Like in a window.or under the eve of the house... :confused:

You don't say in your post - have you tried talking to the parents? Let them know that you have personally witnessed the child throwing rocks at the dog and into your yard, and request (nicely) that they speak to the child and resolve the issue. If they give you a hard time, document the conversation and then the next time the little terror starts in on pooch, call the cops. At the very least it may scare the crap out of the little brat.

Keep the dog leashed when out in front. He may have stayed in your yard this time, but he might get his fill of the kids torture and go after him (can you blame him!). Then you're screwed and pooch is sleeping with the fishies.
