my daughter has never married but lives with the father of her baby. He wants her to leave his house but wont let her take her baby, the police wont do anything about it. They said neither one of them have custody, how does my daughter get custody so her and her baby can leave him? NEED INFO ASAP!!! This is happening in Indiana.

Have her pack a bag and leave when he is not around. File for custody immediately and do not allow any visitation until the court date.

How old is the child ?

Legalbeagle: Won't the judge frown upon this though...Suggesting that the mother is interfereing with the relationship between the father and child. I understand the content of the suggestion, which I wholeheartedly agree with....But couldn't that be taken the wrong way by the judge where the Mother is being uncooperative.? And then judgeing in the fathers favor.?

In this case all she would have to do is rely the threat from the father and state that she feared he would not return the child.

To be honest, you can have visitation, just make sure that others are around and that there is someone to stop him should he decide to just up and leave with the child.
