I was involved in a rear end accident 11/2001 in California. The claims adjuster told me that could not have any B/I with 79.00 damages to my vechicle (per insurance adjuster). I had 2100.00 of doctor bills and a repair bill of 800.00 to my vechicle. I sent a demand letter and it was replied with a big NO! Today I get a letter, It states:

"Your pending person injury claim is assigned to our Clamims Representative, Adjusters name. I trust that your representative explained our claims handling procdure in detail. However, please feel free to call me if you should have any additional questions concerning your claim.

It is our sincere desire to offer prompt, fair and courteous claims service. Therfore, I encourage you to call me personally should you become dissatisfied with the manner in which your claim is being handled"

After being told by the first adjuster that the bio mechanicism was not enough to have injuries now this?? I'm planning on taking them to court and have had no contact with them in over 3 months. Any Ideas what there doing?????

Yeah, they are betting on you being DUMB, not having any money to get a lawyer,

The longer you wait to get a lawyer the less and less and less and LESS money you will get.

Because they dont believe you need all that medical treatment...... and with No lawyer, and no proof from their doctors that you really were injured, dont expect anything for years to come.

So 6 months and no lawyer...hmm sounds like you also had no insurance on your car

Yes did and do have insurance, but since it was a small amount I did not want to hire any attorney. If it comes to push and shove I will. I was a red light stopped, when there insured rear ended me. I did not ask there insure to hit me. If a person cause injury do to fault whats the question? the only question should be how much. I'm not trying to get rich, I just want to have my repairs and medicals paid, why should I turn it in to my insurance which I have already anyways but have. Why should my insurance company pay for something that someone else created or did.

Thats why you have insurance YOUR company pays YOU then sues the other drivers company for reimbursement.

So they figure you didn't have insurance at the time of the accident so why should they offer you a dime!

California

Well today I called the new adjuster to see what was up. She told me that the old adjuster did not leave and she has taken all her claims back. She said that I need to talk with her, so i spoke with her and she tells me that if there is nothing new that she stands and feels the same way. So I told her that was fine if she was dening the claim that I understood her opinion, she had to do what she needed to do and I would like wise do what I needed to do.
