so I'm new and in the middle of a year long court battle with my sons mother. i have been looking for any information on a case like this or if anyone has heard of something like this. i had been paying child care expenses in the amount of 400 a month for nearly a year then it was lowered to 320 a month. the question i have is that i have documented proof from her employer that she has not been working since September of 2007 and i was still paying child care expenses up until a month ago when the judge suspended child care until a evidentary hearing. for the yr and a half prior to her leaving her job in sept 2007 she was off work for a total of almost another six month's. it has worked out that i have paid around 5000 dollars for child care that my son has not been attending.
the other part to this is that during the last yr of fighting with her and back and fourth to court i have incurred almost another 2000 dollars in court cost directly related to her. first of i had to have a ex-parte order signed by the judge when she was denying me summer visitation which ran almost a thousand dollars. the reason for that to begin with was because after we went to court and the lawyers and us agreed on a new order she refused to sign it later on. she has also cost me almost another 1000 by her having to meet with my lawyer to work stuff out, and there is now a deposition scheduled and another court case that will probably end up being in the 1000 dollar area for a total of 3000. and all of this extra in the last yr was because she refused to sign the order that was written up and agreed upon already.
i guess my question is what will they do about the child care expenses that i paid for a total of almost a yr and a half, and the incurred lawyer fees do to her refusing to sign a order? is this something that the judge would make her pay back do to her not giving complete and truthful information to the court and updating records. and the lawyer fees should i just chalk that up as a loss.
