What is the name of your state (only U.S. law)? CA
Custodial parent just had a baby. she is trying to count it as a hardship saying she has to support. She is married to and living with father of baby. Shouldnt he be liable for supporting baby? Is baby counted in calculation with my 2kids child support? Or can only half of hardship amount be counted on her end-responsibility? i feel Im helping support this baby too!:confused:

Is she the one paying support?

Oh, and she is just as responsible for the support of the new baby as the husband is... just like BOTH of you are responsible for supporting YOUR child(ren).

Is she saying she CAN'T pay support because she and the father have a new baby, and that they, between them, decided she should be the parent that stays home, instead of the father sharing caregiving so mom can also keep working and supporting her children?? And that mom is voluntarilly unemployed?

Did she petition to raise your child support because she had another child? Or have you petitioned to lower child support for an undisclosed reason and that is her counter argument?

I pay the mother support. I was laid off and went to court to modify. I have a job now. Mother had a baby and said she wants to claim a new hardship saying she now has to support another child. It did make a difference in the calculations. her husband and her work. My question is can she claim to support this baby and make a difference in amount I pay? We agreed that I would give up my holidays if I could request to see kids with a 7day notice. She has refused to honor this agreement and claims my visitation to have lowered from 20% to 15% and has also raised support! I have seen 2 different judges and BOTH have made mistakes on calculations! Can I ask local childsupport to give me calculations/report so i can take to court? I have ran numbers online calculators and my payment comes up $200 less!! I make a gross of $730/week and am ordered to pay $850/mo. I have a wife and other kids to support.
I really appreciate all your help and suggestions...thank you!

Ok...so you initiated a recalculation/modification and she is asking that everything that legally can be factored in, is factored in. She does have the right to ask that.
