New car was not new

What is the name of your state (only U.S. law)? new york

A family member bought a brand new car last January of the lot of a GM dealer.
She brought it in to another dealer that she lives closer to in September to have general maintenance on it and that dealer noticed paint peeling on the front bumper.
After further checking, there was documentation that the car was in an accident and had repairs done to the front end prior to her buying it from the dealer.
This was not disclosed to the buyer.
The dealer is offering extended warranty but the family member is upset as she bought the car of the lot as new, yet is was not. She prefer to have a new one.


Any advice is appreciated.

First, make sure that she bought a "new" car.

Second, get an attorney. Have him/her send a letter to the dealership threatening nebulous but biblical legal ramifications if the dealership doesn't hand you over a brand new car plus your legal fees.

Then, if the dealership refuses, have that attorney take them to court to sue them for the car, the fees, your time and anything else that the attorney can think of.

Always always ALWAYS run a carfax report on a car you are about to buy. ALWAYS.
