New CO, petitioner (NCP) didn't attend, now what?

I had an earlier post, 'NCP requests to amend visitation'...but I'm technologically challenged and cannot locate it to continue...and I have another question, so here goes:

NCP filed an amendment to 'increase visitation with son'. I filed a response requesting 'no increased visitation be granted as NCP currently attends school M-Th from 6 - 9:30 and leaves son with sitter on weekday visit' (current CO is EO Th @ 6 to Friday @ 6 and alternating w/ends) I also requested a ROFR for any period greater than 90 minutes.

NCP was a no-show for court. He request to increase was denied and mine for ROFR was granted. I have attempted contacting NCP several times to see if he's aware of ROFR, and he is refusing to speak with me. That leads me to believe that he is aware...

However, today is his Thurs. visit and he usually has school...I've text him, asking if he has school, and if so, I'd be keeping Memphis until Friday, I can meet him as early as 7 am...no response.

Is he served with a copy of the amendment to the CO showing ROFR has been granted? I'm unsure of how to handle the situation since his uncommunicative. Any advice, as always, is appreciated.What is the name of your state (only U.S. law)?
