My husband and I signed a contract for a new constuction house in a development in August. We are going through their mortgage company and we are still waiting to close. It is going to be An FHA construction/permanent loan. We were supposed to close within 45 days but everytime I call someone they just keep using excuses as to why we can't close yet. First it was the permit, then the appraisal, and now they just keep blaming it on others. We don't know what to do. Our contract says that the closing is in 45 days except if the seller changes it. I know we were stupid when we signed it. I don't understand why they told us a time frame and now aren't following it even with the closing. I heard horror stories about building but we thought since this was a development and they've sold so many that we were safe. I wish we weren't so nieve.Is there any way we can get out of this? We are worried that even after we close the house will never be done. We were told it would be Feb. or March but now we don't believe them. How can we trust them now? They get irritated everytime I call to ask what's going on. They act like I should know this is normal. We never built a house before and this is worrying us. Please can anyone give us some advice? Thanks.

In addition to HomeGuru's accurate response, one more recommendation...

Purchasing a home is one of the largest transactions that you will probably do in your lifetime. And I can't help but notice from your post it appears that you are trying to do this the 'easy' way... by phone ("everytime I call someone", "We were told", etc.).

Start RIGHT NOW and formalize this process. Write letters listing your expectations and asking them for WRITTEN responses to your letters. Keep copies of ALL correspondence. This in itself may very well solve some of this communication problem. And if it doesn't, you will at least have DOCUMENTS to support you if required in the future. A lot better than just saying... "Well, I called them and they said, and I said and they said....."!
