New Contruction: No Notification on Structural Change

I am having a new home built in McKinney, TX. I am a 1st time home buyer. I am very green to this whole process and trying to understand if I should continue to pursue my concern.

The contract I signed was to have bay windows in the master bedroom and kitchen nook. Each bay window was to have 4 window panels, but instead each only has 3 window panels. I was not notified of this change.

The builder has apologized for not notifying me about the change as they were not aware my contract fell into this new requirement. The builder is advising this change was required to meet energy code requirements. I am asking them to provide me the code that justified this change but they are not willing to provide me this information.

I want to have this provided to confirm there is a code change from state, local or federal gov that justifications this change being made. As per my contract it advises there may be changes to the "construction documents" that require code compliance for state, local and federal gov.

I feel if they can not provide this code that required this change from any of the above then they are in breach of the contract.

Am i way off based at this point?

I cannot imagine any kind of code requirement that would require someone to install three panel windows instead of 4 panel windows. I think that the builder messed up, or was trying to shave money off of his costs, and is trying to pass it off as some sort of code issue.

It seems to me like you are being excessively nit picky about the number of window panels...
If you had ever seen a three panel bay window vs a four panel you wouldn't say that. The look is completely different. A 4 panel bay window is a semi circle...and three panel is more like a triangle with one blunt side.
