We purchased 60 acres of wooded land (no buildings) approx. 1 month ago in rural Missouri. 100 yards of this property on the north side is being disputed by the adjacent owner who has owned his property for a number of years. The property was survey prior to closing by the seller. The adjacent owner, has built a fence (this weekend) where he feels the property line is. Our local law enforcement states this is a civil matter and the title insurance company says, "So what?" hire an attorney.
My question is, what is my title insurance for if is does not guarantee what property is mine? The title insurance, survey fees, etc. were an expense. Why is no one responsible for verification of this dispute now?

Title insurance insures clear title to the property. You have this. What your issue with the neighbor is has to do with encoachments of the fence. This is a civil matter and has nothing to do with the title insurance.

Is it the responsibility of the Title Insurance Company to insure and/or guarantee that the boundary lines are accurate? They charge a substantial fee for their services. If they do not give this assurance then who protects the buyer?

If you had a survey done prior to closing, then you should have been provided with a survey map AT the closing, or very shortly afterward. This survey will show what the surveyor found to be the accurate property lines.

Property Line Dispute

Duncantls:

I am dealing with a similar situation in a rural Missouti community. I would like to give you information that I have received from an attorney that specializes in this area of law. It is in fact a civil issue and one that can be quite taxing on YOUR wallet if you are angry enough to pursue it. Regarding the replies about your title insurance, they are correct.

I would like to talk with you in more detail. Please email me at [email protected] and I will give you my phone....let's talk. I will be glad to share the particulars with you as I realize how frustrating these types of neighbors can be. This will be my second time around with an issue such as this!
