My girlfriend was previously married for 8 years. In the time of her marriage she owned two properties which were in her name only, along with a few other assets. During the divorce proceedings the judge ruled to split evenly both the properties due to marital assets. The divorce stated that the ex-husband would assume possession of one property and that he must qualify for a loan to have her name removed. However, a specific date was never set in the divorce stating a time frame in which that property had to be transferred out of her name. Presently, it has been over three years since my girlfriends divorce with no transfer made to have her name removed of the loan of the house. The ex-husband does not work, but just feeds off family to pay his way through life. There is no way he would ever get approved for a loan to take official ownership of the property. Now, for almost 2 years he has been living on the property making zero payments. This has only affected my girlfriend and her credit since it is only her name on the property. So, she legally owns the property but has no rights to it because of marital assets. This makes no sense whatsoever!! She has spent over $6,000 in attorney fees trying to have him removed from the property because he cannot assume the loan in his name, and because a payment has not been made in almost two years she is the only one affected by this. Is there a law in the State of Florida or any law that could help with this case; because this is just wrong in every way!!! How can someone live in a home and not make payments without being evicted and foreclosed on? Why is it my girlfriend’s credit has to be destroyed because a divorce judge split property up to an ex-husband who had no job and could not afford it? Any advice would be helpful on this issue please? His name was never on any of the assets from the very beginning, she was the only one who worked to make a difference. They had no kids, so there was not an excuse to ever find a job. Also, he was the one who filed for the divorce. My girlfriend is a very kind, hard working patient woman and does not deserve this. She deserves to move on with her life and not deal with the stress from an idiot who is just playing the legal system without any consequences, but on her expense. ANY LEGAL ADVICE PLEASE!!!!!
