Hi all, I need help again...
The duplex i live in has been sold...the new owner takes over tomorrow...we do not have a lease we rent month to month.
For the past two months the guy who is buying the house has been just showing up here without any notice bringing all kinds of construction workers and inspectors etc in my house. I realize this is my fault for allowing it but since he is buying the place I thought it would be in our better interest to cooperate with him. Then about two weeks ago he came over with an inspector guy and this guy starts going through my drawers and cupboards..I said are you gonna go through all my stuff? and the guy says (real snotty like) yeah, why you have something to hide? This offended me and pissed me off. The guy who is buying the place turns around and says to me we are just trying to get the place fixed up so you will have a nice place to live. Then 2 days later I get a letter from the current landlord(on aug 6) saying move out by aug 24th(my rent is paid until Sept 2). At this point i decided no one else is comming in. The current owners and the guy who is buying have been sending droves of people over here without so much as even a phone call notice...they just show up. When i refused to let them in the current landlord starts calling telling me that letting them in is NOT optional. I didn't let them in. Today the guy buying the place showed up and we were on our way to a doctor appointment. They asked if they could get in our apt...we told them NO...about 30 minutes later they call my husbands cell phone to tell him the key in the lock box is missing(in otherwords they tried to go in anyway).
The question is: I know the law says I have to allow the landlord entry...also says he has to give notice before....BUT what I want to know is if I absolutly refuse to allow him in what can he do? I mean is the answer he can evict me? Or is there some law that will allow him to force me to let him in? Because if the only thing he can do about it is evict me then I will NOT let him in...we are moving as soon as we find a place anyway and I realize that an eviction is a BAD thing on your record but I REALLY DON"T WANT HIM IN MY HOUSE! I'm willing to take the eviction but I want to make sure I am within my legal rights to say NO.
And yes I understand that if there is an emergency he can come in and if there were an emergency I would gladly let him in but he is just showing up everyday wanting to walk around and look at things. He came in with the realtor one day and stood in my BEDROOM for half an hour chatting with the realtor about his business...hello I LIVE here!!!
He came over today and shut off the water....and he doesnt even own the place until tomorrow...and thats illegal anyway!! So if hes this bad before he owns it Im afraid to see what he does when he owns it. I dont trust him! I DONT want him in my house!

And i know everyone is going to say move...we are trying to do that but we have to find a place first so leaving tomorrow is not an option!

Good... Than you realize that the LL can give you a 30-day notice to vacate for any reason. On top of that, the LL MUST give YOU a 30-day notice to vacate.

The LL MUST give you a MINIMUM of 24hrs. notice to enter the unit, and it must be within reasonable hours... Showing up at 8 P.M. is not reasonable.

Tell him to pound sand. He MUST give you 30-days notice to vacate UNLESS otherwise noted in your lease, and/or LL/T laws of your state. Verify.

LL is WRONG... He MUST notify you.

Good... The next time they get in without your consent, call the police and report a "breaking in and entering"

You MUST let him in once PROPER notice to enter has been given... He CANNOT force his way in or show up on a whim. UNLESS for a valid emergency reason.

Well in NC if you don't have a lease the law says they only have to give you a 7 day notice BUT.. it also says they should give you the notice at least 30 days before the current rental period ends.

Ok I know by law LL can enter with a 24 hour notice....what I need to know is what happens if I still refuse to let him in? Can he somehow force me to let him in? Can he have to police come and force me to let him in? Or is it that if I still refuse to let him in after giving notice that is grounds for evicting us? Because although I understand being evicted is really BAD and we don't want that on our credit report etc. ( and we hope to be able to find a place and be out of here before it gets that far) But I really really don't want this guy bugging me anymore...enough that I am willing to chance the eviction process to keep him out...I just need to make sure that I can't be arrested or something like that for not letting him in...bottom line what happens if I simple refuse to allow him in period!?
Also what is to prevent him from just telling me everyday when he is here that he is comming in again tomorrow?

8pm is NOT unreasonable necessarily. It may be unreasonable in your opinion but your opinion is NOT the legal opinion.
As for letting him in -- if he shows up after giving you the required notice you then are obligated to let him in.
