I have recently purchased a home. The closing papers were signed on 5/18. The sellers have decided to hold a public auction at the home on 6/12. From what I understand,I am the legal owner of the property. I do not want a public auction held at the home. Is there any way I can stop this legally and how do I go about stopping it? If you know the auctioneers, write them a letter saying that this is YOUR home now and if they show up to conduct an auction on 6/12, you'll have them and anyone who attends arrested for trespassing. If you have a gate across your lane, close and lock it on the 11th. Do the former owners still have property there? Why haven't they moved it? Tell them to pick up their stuff, at your convenience, or you'll charge them storage fees.

Tracy, Thank you so much for your quick response. I did already call the auction house and tried to talk to them but was told that since we do not take physical possesion of the property untill the 18th that there was nothing we could do about it. I figured that since the deed had been transfered and I am paying for the house I had the right to refuse the auction. Thank you once again, Lori

OOHHHHHHH. You didn't say that before. The old owners are your tenants until the 18th. They get to invite anyone they like over to their home. Holding an garage sale or auction is a reasonable action. You lose, I'm afraid.
