I am a landlord in the state of florida. I recently put a for rent sign in the window of the rental property. A prospective tenant drove up and wanted to see the house, upon agreeing with the rental amount and the security amount the prospective tenant agreed to the terms. I urged the couple to go home and think about it and be sure it was what they wanted and get back to me, they drove away and came back in 5 minutes. They got out of the car and said they wanted to go ahead and pay the security that they wanted the house. I accepted the check and informed them there were still a few things I needed to remove from the house and some touch up painting that needed doing, all were in agreement, the amount of the check was $300., the monthly rent would be $525., that was 11/22/00. $525 would be due the folllowing week of the first, I gave them a key and told them they could move some of their belongings in. I removed the sign from the property, I turned away 3 interested parties on the property on the eve of 11/22. The husband called me on the 23rd and said that due to the short employment week that he did not want the rent to be late so to keep the $300 check and he would pay the difference on the 1st to make the $525 rent but that they would need a little more time to pay the $300 deposit, I agreed. I hired a painter to repaint some of the rooms on the 24th at a cost of $150, I would normally have done this job myself but I explained to the tenant that I worked Friday and Saturday and Sunday, however the tenant was insistent that they needed to get in as soon as possible.
Today is Sunday 11/26/00, Mrs tenant called my husband, at 6pm saying they decided that they could not afford the house any longer and wanted their $300 back. My question is who is entitled to this money??, The tenant for changing their mind, or the landlord who took it off the market turned other prospective tenants away and ruhad to rush to have it painted, thus costing $150?

No there was no written lease it was to be a month to month oral lease, and no they had not moved anything in.
