The mother can give the baby any last name she wants. You can fight in court to have it changed after the fact, but that probably isn't where you are going to want to concentrate your efforts.

Listen...you simply NEED to understand that since you two were never married, there is no presumption of paternity like there is with married couples.

So until the baby is born AND a DNA test determines you to be the father of the child, you have no legal rights and the mom has no legal obligation to tell you anything or talk to you. SHe also doesn't need to initiate any action either. But YOU can be proactive -- but again, as others have mentioned, NOT until AFTER the baby is born.

You need to consult with some attorneys so they can tell you what your rights are if you are the father, which includes petitioning to have the child having your last name.
