My daughter had gestational diabetes with her first baby which weighed 8 lbs 12 oz. She was closely monitored and put on a strict diet although she was not overweight. Everything was fine.

She measured big throughout her second pregnancy. Her due date was set for 02/02/2010. Dec. 23rd she was suppose to be 34.1 weeks, but measured 38.5 weeks. The doctor ordered an ultrasound and said the baby was in the top 10 percentile for gestational age. Dr. said an ultrasound would be given at each appointment to make sure the baby didn't get too big for delivery. At the next appt. 2 weeks later she saw a different doctor. He was very lax in measuring her and said she measured 37 weeks. Daughter asked about the ultrasound and Dr. said they would give her one when she was closer to her due date. Daughter mentioned the previous Dr's concerns. He sent her home without re-measuring or ultrasound.

One week later daughter measures 40 weeks (different Dr). Ultrasound was ordered. They told us baby was 7.5 to 8 lbs. Said she shouldn't have any problems delivering. Daughter asked to be induced because she thought the baby was too large.

Induction took place Jan. 25, 2010. Baby's head delivered with difficulty. Son-in-law and I watched in horror as the head turned to a deep purple color. Doctor grew more and more frantic as baby was stuck. Doctor pulled and twisted baby in a panic. Alarm went off and about appx. 10 medical staff burst into delivery room. One staff member got on delivery table and pushed down on my daughters stomach as Dr. grabbed scissors and aggressively cut my daughter. When baby finally came out, he was solid deep purple and lifeless. Staff rushed him to a table. Daughter and I kept asking if he was ok. One staff member kept telling us, "They're working on him". Baby finally cries and we thought he was ok. He weighed 10 lbs 5 oz. 21 1/2 inches long.

Pediatrician saw him later that day and said baby has nerve damage in left shoulder/arm due to the delivery (Erb's Palsy). He will refer to Scottish Rite and baby will need physical therapy and may never be able to use his arm. We do not yet know if there is any brain damage.

I believe this was due to negligence to monitor her for gestational diabetes, failure to accurately estimate the size/weight of baby, failure to perform ultrasounds as ordered by first Dr, failure to take seriously her measurement of 38.5 weeks at 34.1 weeks gestation, failure to prepare for a difficult delivery, and failure to perform proven techniques to avoid injury.

I don't see a question in there, but if the parents want to take legal action, they need to talk to a lawyer.
