newly seperated, need to know if a written agreement is binding in divorce court

I am newly seperated. My husband commited adultery and abandoned myself and our 2 year old. I had him sign an agreement of bills he orally promised to pay, even added my attorneys fees for the divorce. Would the judge order the agreement as a binding contract as part of our divorce.I live in Virginia.

My response:

Probably not. If you are writing this "agreement" up yourself, it's undoubtedly legally insufficient. You never mentioned any other necessary terms and conditions; so, I have to presume from your post that you have not written the agreement properly.

As an indicator, if your agreement is not at least 3 pages in length, taking into consideration your child, and all other necessary matters, I can tell you right now that it's insufficient and worthless.

Please, for your own sake, and the sake of your child, have a proper agreement written, and then file your Petition for divorce so that a judge will have something legally sufficient in front of him to sign - - rather than rejecting the "agreement".

See an attorney as soon as possible.
