NH landlord keeps utility funds

We signed a lease to pay utilities in addition to rent. 3-unit bldg has single electric meter (in landlords name) and single oil burner (landlord's oil acct). After 3 months rec'd no invoice for utility. So paid upfront $225 for oil and $50 for electric, asking for invoices. (This was our best estimate our our 1/3 share.) Still no bills. One oil delivery was made after we paid. No other tenant paid for oil. Tank is now empty and landlord told downstairs tenant to ask us to pay for the next fuel delivery. When asked, landlord said she applied $100. of our oil money to oil, with no explanation about the other $125. Also lease calls for tenants to share yardwork and snow removal. We later discovered that no other tenant is required to share, so we are stuck with all. And, Landlord had agreed 1 month ago to soundproof front entrance because downstairs tenant's dog snarls at us, she has a loud squawky parrot, and that tenants "private" behaviors are easily overheard upstairs in our living space. This Interferes with quiet enjoyment, and lease requires landlord to address noise issues. Has not followed through and problems continue. We think if we pay our 1/3 of utilities as agreed, landlord has to deal with the rest through contracts with other tenants. Has landlord breached her responsibilities?

Have you asked the landlord what they did with the extra $125?

Likely it went to pay for the electricity. Your bill would certainly have been higher than $50 for three months usage.

Does your lease specify a portion of utility cost , or just rent and utilities ?

Call the providers and ask what the cost is/was .
