NJ .. daughter received reckless driving on probationary license

My daughter (17) received a reckless driving ticket for going 95 in a 65. She has a probationary license. Lawyers are not really affordable. Any idea what we are looking at for penalties and license suspension? Any ideas on any kind of plea deal to a lesser offense (though I’m not sure that’s allowed in NJ).

Would you please post the code/statute she was charged under?

NJSA 39:4-96 but it’s different for someone with a graduated / probationary license as penalties are affected by those laws.

She is looking at possible jail time (up to 60 days) and some fines. She will likely have her license suspended as well.

I would suggest an attorney because of the possibility of jail...although considering what she did really deserves jail time. Perhaps she will have more respect for others on the road if she has to deal with the consequences of the reckless and dangerous behavior.

Hopefully you will not allow her to drive if by some small miracle she doesn't lose her license. You should also make her pay ALL costs associated with her little joy ride. ;)

Oh im not paying one cent towards this. She literally had her license for 3 weeks and she’s pulling this. I had a lead foot too when I was young and stupid but I was the king of 2 pointers never anything like a reckless and I had to deal with the financial ramifications of it and leaned my lesson. I support my kids and help wherever I can but i draw the line at paying for their crimes.

Your daughter will likely lose her probationary license and delay her ability to get her "real" license. She will also likely get points on her license, which will affect both her ability to get insurance and the premiums charged. Of course, her current "stunt" may well result in *your* premiums going up. I'd talk to your insurance agent - perhaps having her listed as an excluded driver on your policy will help in that regard?

She *may* also be required to enroll in NJ's Probationary Driver Program...
Drivers that are issued a driver's license permit for the first time are probationary drivers and will have to serve a two-year probationary period. While in the probationary period, drivers who are convicted of two or more moving violations with a total of four or more points, will receive a Fee Due notice to pay for and enroll in the Probationary Driver Program to correct improper or dangerous driving practices. This program is a four-hour classroom program provided by approved New Jersey-licensed providers throughout the state. Up to three points will be removed from your driving record if you successfully complete the program. A $75 administrative fee payable to the MVC is required prior to scheduling a class with a New Jersey-licensed provider. Drivers will be required to pay an additional training fee to the provider for the classroom instruction.

If this were *my* daughter? I'd tell her that, when she gets her license back (probably not before 18), she will not be covered by your insurance, nor will she be permitted to drive any of my vehicles. I'd also hand her public transport schedules, and let her know that her curfew will be guided by said schedules, as I would not be acting as her chauffeur outside of emergent situations (and specify what those are). She can certainly use Uber - at her expense.

Well here is a rather large update. She wasn’t entirely honest an out her ticket well actually tickets. The reckless is true but she also got speeding 40-45 over (103 in a 55) and not on an interstate type road but a highway with lights and people turning on and off. Even with a lawyer I don’t see how much of the 10 points she’s facing can be shaved off. Her goose is past cooked, it’s a burnt charred mess.

sigh... yeah, she is in trouble. I suggest having at least a consult with a local attorney. You can call the NJ State Bar Association for referrals.

I'm curious... and assuming this is one of the girls you adopted & posted about ~6 years ago... What ever happened with their brother? Is that, by chance, part of what's at play here? Is she in therapy (or has she been)? Is she in contact with her birth family?

(no, not just being nosy... thinking maybe there are other suggestions we could come up with... We have a wealth of parental exprience here - good & bad...)

He’s still a bit of a thorn and I know he’s contacting her and I know he gave their federally incarcerated mother her phone number (which invlocked at the carrier level) but he also likes to grow marijuana so I have that plus years of infringing and interfering with my parental rights. But he has nothing to do with this.
