My friend just got a DWI in NJ but he tested .05 (under the limit). I know he will still get charged but what can he expect as far as the charges being reduced/dropped?

He also got caught with a small amount of marijuana.

Should he spend the money on a lawyer or will a PD be able to handle this just as well?

He left with his license, does this mean he has a good chance of not having his license suspended?

0.08 is only the per se limit where they don't have to show he was intoxicated by other means. How strong of a case the state has we can not tell.

Public defenders aren't a freebie for those who are unwilling to pay for their legal assistance, they are provided to the indigent who are unable to afford counsel.

He needs a lawyer.

As Ron stated, just because he tested under .08 does NOT give him a free pass.

No one can judge this case based on the details provided. The police report will be a key factor.

None. Especially with;

If he can afford a lawyer- he would not qualify for a PD. It's not his decision.

His licence is suspended when found guilty in court. He can drive, until that happens. The court 'MAY' issue him a special waiver- depending on distance from the court he lives- for a few hours or the day for him to drive home. After that, no licence for however long the court states.
Plus $3000 in fees to DMV.
Plus court costs.
Plus fines.
Plus the permanent DWI on his driving record.
Plus the increase in insurance costs (or just being dropped by his carrier).
And, almost forgot, if he got a lawyer who could not get the charge dropped... Plus the lawyers costs.

What were the circumstances surrounding the arrest? Why did the police stop him in the first place?
