How can they call my fiance's ex the custodian parent when they have never been to court or have any documented papers that state she is?
We have his kids every weekend and every time we are off. She has them half the time on holidays and we have them the other half.
Everyonce in awhile she threatens not to let him see the kids. It is only when she wants more money but it doesn't last long because she doesn't want to keep them on the weekends.

Was he married to this woman? I'm assuming not, because if he had been married to her, then the issues of custody/child support/visitation would have been dealt with during the divorce. If he wasn't married to her, did he sign an 'affidavit of parentage' for these children, in order for his name to be on the birth certificates?
 
They were not married. He lived with her for 9 yrs was there when both his kids was born. His name in on both birth certificates.

Mom's custody was automatically established when the children were born. His was not because he was not married to their mother.

Also, the children apparently live with her the majority of the time...and presumably he pays child support...both of which continue to establish her as the custodial parent.
