I live in Tennessee.. I need to know if my husband can request child support on previous yrs although he has never gotten a court order requesting child support but agreed that he did'nt want child support from me ..(Agreement was not legally documented)

Your husband? So your not yet divorce? He has custody of the children? Is this court ordered?

Yes, he can request it.

OOOps! no, sorry .. not my husband.. x hubby..bad habit!! LOL
My son stayed with his father for a couple of yrs so that he could attend his old school.. I did'nt try and force my son to stay with me but gave him freedom to choose so that he could go to his old school.. k?

also .. There has never been a court order for my x hubby to recieve any child support from me and he told my he did'nt want any from me.. NOw he is holding a threat over my head to go back and request it if I should attempt to sue him for any support..

This is going to be a long thread... Tell me about the custody order. Who has legal court ordered cusotdy of the children?

How can *you* sue him for support?

Ok, see i am gonna have to be very careful in how I state things here..so , maybe sue is the wrong word..I should have said request!
now, to answer the last question..We have joint custody.
also in the court order there is no mention of my ever having to pay support but it does state that should the child reside with his mother the father shall pay support

LegalB... after reading over this I now realize why u asked "how could I sue for support" I guess I did'nt make it clear that my son is now in my custody and has been now for over a yr. HIs dad was paying me $100. a wk in support but now that he is remarried he is only paying $50.00
I hope this clarifies some questions that u had.

Legal is only trying to help you. He may come off sarcastic at times, but his heart is in the right place. First of all he doesn't have to answer any or our questions. He is taking time from his busy lawyer day to help poor souls like us out.

He only needs to know exactly what you are trying to ask, that is why he keeps at you about the post.

Thanks! I do appreaciate that he is trying to help and after reading over what I had said before I can see where he was having a problem to understand. This is my first time in this forum and I am having a little problem to get my message across accurately..Don't want to sound ungrateful.. Just really need answers.
Also I did'nt have a clue who legalb was..was'nt sure if he was just someone who hated ppl who asked for childsupport and liked to harass..If ya don't know ya gotta ask.. right? :-)

Actually, I rarely post with the intent to wound or to ridicule people. I do hold some people in 'contempt' but that is when 'Best Interest of the Child' is totally foreign to them.

And no you would never purposely hurt anyone, that is what I said...duh! You only try to help, and if people are offended in anyway, the perhaps that just means their guilty in the first place?

The best interest for a child is to insure first of all that a child can eat , have shelter and clothing because without these first two he will surely die then none else will matter..As far as judging what is "Best Interest" first of all you need all possible information to determine this..I would say to withold eye glasses and clothing from a child in order to get back at a former spouse is not best interest.. So there are many factors in these cases.. not cut and dried as some would seem to think! Sometimes two ppl can be agreeing on best interest of the child and a third party can come in and change that too..right?

I think i have your answers:

1. You and ex made verbal agreement that child stay with him.
At that time ex didn't want support. All verbal.

2. Verbal isn't worth the paper it is written on. LOL

3. You have a court order that never was modified for 100 per
week, therefore, you could go back to court and file arrears
which would be legal, but not fair as he did support him that
amount of time.

4. He is currently only paying you 50 a week, He is in contempt of the court order as he never got it modified in court. So, I would bring him back to court, and go by his and your income and have the judge determine how much support you are legally entitled to.
