My ex-husband and I got our divorce but have had no custody trial. He moved with our daughter and his new wife without telling me. I located him first by phone. The next day the number was disconnected. I found his address. I was immediately told by his new wife I was not to enter the property again. I have not seen my daughter for 6 months. I have absolutely no contact with her. He and his family do not call or write. Since there has been no custody arrangement what can I do? I have no money for a lawyer and and a new baby on the way. I am just curious as to why there was no custody order established at the final divorce hearing? That is highly unusual for a court not to rule on that in a divorce where there are children.

You are going to need to petition the SC court for custody, since there is no order established and you dont have possession of the child you will need to do this soon or they can get you for abandonment.

My ex-husband did not finish paying the lawyer and he withdrew from the case. The divorce was already finalized by then. I never received papers stating that I was divorced or anything about a custody hearing. I need a lawyer but I can't seem to get assistance here in South Carolina. Misty Thomas
