An ex-boyfriend and myself have a child together. For now neither one of us have custody and it is working just fine. Here within the next few months, My fiance' and I want to move to Florida. I don't want a big hassle from my child's father. I wouldn't dream of trying to stop my child's father from seeing him. My fiance and I just can't seem to make a decent living in the are we are in. Since neither one of us have custody and the child lives with me, what are my rights as to leaving the state with my son? Yes, my son's father pays child support.

BIG PROBLEM>>>>

:eek: he can fight you for custody thats the first thing, the judge can very well tell you if you want to leave then leave the child behind iwth the father.... however before i make a big response of this DOES the father have any clue that youwant to move? did you try talking it over maybe making the plan appealing to him? such as he can have her for 3/4 of the whole summer and on all shcool LONG vacations etc.? How often does he see her now...?

No the father doesnt know yet. I wanted to get some info on what I might be up against first. All these ideas have already entered my mind. My son's father sees him whenever he wants. But I pretty much figured he could fight for custody.

Lets figure this out.... you may actually NOT have a problem YET

:eek: well, he lives with you so in theory you have custody, and if this issue hadnt come up you wounldnt be disputing custody..... heres what i recommend, your not married, he has NO PAPERS YET SAYING HE IS THE FATHER RIGHT meaning NO PATERNITY TEST or did you get that done when you sued for child support....

Yes there are papers saying he is the father. Court ordered child support.

Be aware that the father can petition to stop the move - and in CA most courts frown upon allowing a parent to move a child states away from the other parent...without clear and convincing evidence that it would benefit the child. (Not the parent, the CHILD)

Wanting to find a better job, practically on the other end of the country, won't be enough.

I have been struggling to make a better life for me and my child since he was born and California is NOT the place a person can do that. I have lived here all my life and it really reeks. I haven't made this decision lightly by any means. I have an older son and daughter in law and my parents here too, but they don't pay my bills.
