Refinanced with a "cash out" mortgage with a sub prime lender. Closing took place at my residence, on Thurs Oct 20. Closing agent was from the title insurance company. Right to cancel ended Mon Oct 24. Disbursement date Was Tu Oct 25 (this is typed in closing documents). Can't get my mortgage salesman to call back, can't get the "emergency" manager to return my calls, and still don't have any funds. What rights/remedies do I have?
There are no encumbrances or deed restictions/title flaws on my house or land. The lending company is affiliated with a large, national banking corporation.
I know I left out a lot of detail, trying to keep it short.

I am totally ignorant to the refi world so my question might be stupid but how are these funds disbursed, mail, overnight, fedex. by hand?

If by mail it is still a bit early to panic, or one of these clowns (used lovingly)around here will tell me I haven't a clue!

The loan officer verbally told me a check would be fedex'd overnight and that I'd receive it Thursday, at the latest. Fed Ex did not have anything in their system coming to my address, but the rep said that without the tracking number they could not be certain. I have reviewed all of the documents several times and I can't find any wording about the actual transfer.

Did you call the title company? They are the ones that will send the check to you? Call & find out if the lender authorized funding and if not, why not?

Are you able to make a personal appearance at your loan officers office and the title companies office? If so, do it. Don't let them hide behind the telephone.
 
Thanks for your reply. The lenders blamed the title company for the delay, check received yesterday with interest for two business days.
