No Insurance, accident

My husband was recently involved in an accident that was the other persons fault. Their insurance has been great paying for everything, however we requested the insurance waiver on the rental car. Wanted to make sure that the car was covered. Anyway, since we had full coverage on the vehicle, their insurance won't pay. They want a statement from our insuarance that they wouldn't cover the rental before they will pay for it. Trying to get this settled, I discovered that our insurance had lapsed and at the time of the accident we were not covered. The rental has been returned with no damage and we have our car back. Wondering if not having insurance could screw us and we have to reimburse their insurance. We live and Virginia and I've heard that if a party doesn't have insurance the accident automaticly becomes their fault. Really scared over $2,000 worth of damage. Your help is greatly appreciated.
