No damage beyond normal wear and tear has occurred with the exception of a door. My nephew will replace the door before he leaves.
Another question. The home went to sherriff's sale and the owner has 6 months to redeem. Clearly the owner was not paying mortgage payments with the rent.
Assuming he's not able to redeem, how does the foreclosure impact the owners ability to sue and win for...well, anything?
See my nephew was consdidering buying the home but the owner was dragging his feet on signing a purchase agreement. Then the property went to sherriff's sale and now the owner is pissed he has opted not to buy the home. I'm afraid he'll seek retribution.
Not that this is relevant, but I think the owner was hoping to have his partner bid on the home at auction and get it back for a lot less then what was owed on it and then sell it to my nephew and turn a loss into a gain. Not sure if the owner knew about the possiblity for a deficieny judgment or that there was no guarantee the bank was going to sell at a loss at auction. He was bragging one day that he had this plan and if it worked, he was going to write a book. Something tells me he won't be writing that book.
