no lease with tenant

we live in sc but the property in question is in maine.
this house was purchased by my husband to help out a friend.
no written lease. he has been paying the mortgage without getting rent.
this person was supose to purchase the house.
3 weeks ago he told this person that they had till the end of the year
to purchase the house or they had to leave. they were also told to pay
rent to cover the mortgage. we have not heard back from this person.
what rights does my husband the landloard have, and what rights do the
tenents have?
would it be best to get a legal lease signed with specifics of what happens
if they dont pay lease and how long they have to purchase the house.
since there is nothing in writing can we tell them to leave now? do we need
to write this person a letter stating that we want their family out so we can
sell the house?
what is involved in an eviction and how much time does it take and how much
money will it cost?
what are our best options to get this family out asap?

Since you dont live near the property the best solution I can suggest is use this website to find a attorney In the state where the property is and have the attorney do the eviction . And afterwards If your ever going to let any one live in it as a tenant hire a professional property manager to handle it because of the distance .

i have suggested a frim to handle the rental house. what i didnt mention
and of course it is a sensitive issue for me. the female was my husbands mistress.
since the house is in his name he thinks i cant throw her out. he purchased it during our
marriage and also spent our money and took the down payment out of our 401K.
i am considering seeing a lawyer here to see what my rights are. all i have to do is find
the $$$. he has pretty much bankrupted us with all of this. we have to sell our house
to pay off all the debts. he is still paying off all her jewlery, furniture, and many gifts.:mad: :mad:


Consult with a good Family Law attorney where you reside now ASAP

I don't know the details, nor do I care, but it sounds to me like your husband is allocating marital assets to set up his future, which might not include you.
