my mother has joint ownership of real estate property. her sister is died leaving several children. the family thought there was a will but they are unable to locate it. they went to probate court. the judge stated that the children need to produce a will or sign consent to their right of property. it has been over four months since the death. nothing has been done concerning the house. my mother would like to sell the house to claim her half of the property. what could she do to speed up the process? how does she go about getting her half of the real estate. the property was left to the sisters by deaceased relatives.

Nothing can be done without the approval of the Probate Court as said Court has jurisdiction over the property.

Thank you for the quick response. Should my Mother go back to probate to get the ball rolling or does she have to wait until the children decide what to do. The house is just sitting unoccupied. Does she have a right to go to probate on this issue? She is thinking about the taxes on the house. She would really like to get this resolved asap.
