No move in inspection

No move in inspection UPDATED!!!!!

We moved out of our trailer about 1.5 months ago. On the day before move out my husband and I went and cleaned up everything from top to bottom and cleaned out the back yard spot less all the weeds and everything. On the day of the walk through our landlord was being overly picky saying there was some dust on the book shelves and the carpet had some sand on it from our shoes that day. In the back yard there were 4 small pieces of dog poop and my kids and used side walk chalk and drew some flowers and just scribbles on the brick wall outside we took so many pics of how clean we left the house it was so much cleaner than when we moved in, when we moved in our trailer was used as a storage unit and we had to wait for the maintence crew come and move out the furniture before we could move in our stuff we were actually moving in as they were moving the stuff out. When we moved in the house was so nasty there were dead mice and mouse droppings all over the house I told my landlord about it they ignored it. We had a 6 month lease and HOA dues which made us pay for security which we never got a park with huge holes in it and we had to pay for maintence HOA was added ontop or our rent not included in it. Now our landlord is trying to get cleaning and carpet replacement from us. My question is seeing how we never had a move in can they do that?

Ok well my husband and I finally got a court date to argue the cost damages, there wasn't any ndamages and I was told carpet was a wear and tear item. How well do you think we'll do in court? We have tons of pics and video tape of how clean we left the house. We know that our old landlords are being very greedy(which landlord isn't?) I also have a couple of other questions.

We payed HOA dues on teh thought we we're going to own the home not rent it the lied to us saying we we're paying a moratage later on we found out they we're giving us a trial test to see if they wanted us to stay. They never told us we were on a test run to own the place. Could we ask for HOA back?

Also if you are renting dont you get maintence automatically?

Again we were told that if we're renting then the landlord is responsible for maintence. Our HOA paid for maintence.

Also we never saw a move in inspection, when I asked for a copy of one when we moved out the operations manager got this panicked look on her face and she said that it will take a while for them to find it. It took them around 1 hr to "find" it and it wasn't the orginal it was a copy and it DID NOT have mine or my husbands signature on it. When I asked to see the orginal they refused to let me see it.

Having pictures and videotape is good, but nobody can tell you how this is going to turn out.

You see it is my fault this time that the FA crystal ball is out of order. I took it to the rink to practice my Curling. oops.
 
Update!

we had out court hearing yesterday!!!!! It was awesome our old landlord was asking for a lil over $800 worth of damages.

Damage list:

oil spots in the driveway= $100
Cleaning the house inside=$450
Cleaning the house outside= $100
Repairs to the carpet $50
Carpet cleaning=$50
and fixing a aluminum decortive vent outside of the house=$50
=$800

We came to court so prepared we had date stamped pics from everything they were claiming and what really owned them was the unsigned move in inspection we told the judge we got then on the day of move out we dont know when they made and that we never had the chance to agree/disagree/dispute any of the things on that move in inspection and that we left the house as it was if not better than when we moved in. The judge told our old landlords that it was there job to prove we damaged all the things they said we did and they couldn't.

The judge told them that driveways are meant for cars and cars sometimes leak oil so they aren't getting the drive way, also the carpet cleaning is normal wear and tear and they weren't getting that, our pics showed the house was clean so but to clean it again for future people he gave them $115 that included the repairs/cleaning to the carpet also. the outside cleaning our pics showed and we admitted we left a couple of papers in the yard and tried to get all the dog poop out but we couldn't get every single piece so some were left. We also have 2 toddlers and they drew on a brick wall outside with sidewalk chalk.

Our old landlors said the children left graffiti on the wall the judge told them its side walk chalk and it doesn't look offensive. He told them it doesn't take much to pick up some papers and a couple pieces of dog poop and that a hose would clean off the brick wall so he only gave them $10 for cleaning outside. And that no way does an aluminum decortive vent cost $50 he gave them $5 for the vent and $10 for the labor.

At this point our old landlords were SO pissed they didn't get everything they asked for.
We also had a past due sewer bill for $103 he also gave them that.

Yeah we lost but they aren't getting everything they asked for. But the judge saw past all their BS and told them they need to learn how to conduct their business. And that they should have come better prepared. Walking out of the court room our old landlords booked it but they got stuck at the elevator and they were pouting and my hubby and I walked around the corner laughing it pissed them off even more . It was prett great.

Congratulations. Sounds as justice was served.

Now, when you move into another place (or as soon after as you can) take pictures and/or video of the home to prove what/if there are any problems when you moved in. Also, be sure to get copies of all documents that you sign; i.e. lease, move in inspection, etc.
 
Oh yeah this was a huge live and learn lesson for us. We also descided that when we pay then we'll go in person and give them $1 bills and make them count them out just to annoy this crap out of them. Our next time will be buying a home not renting one and we have our digital cam when we moved into our rental we didn't have that until later but thank gawd we had it !
