This is not my situation but that of someone I know.
A young couple that I know were in an argument while in the car. Lonny was driving and Jane had the passenger door open attempting to get out of the moving car. Jane has bipolar disorder, and was in a manic state in a fit of rage and not taking her medication. Lonnie was holding onto Jane by the jacket sleeve until he could get to a place on the 2 lane road that would provide him a place to pull over. There was a car directly behind them and the driver was an off duty police officer who called for assistance. Lonnie allowed Jane to get out of the car when he stopped and she ran down the side of the road. The off duty police officer stopped behind Lonny. The officer that arrived on the scene picked Jane up--I am not sure what she told the officer. The officer ordered Lonny to drive to the police station so they could discuss this. He was interogated for quite a long time, but was finally allowed to go. There was no physical abuse claimed by either party. The police said they are sending the statements to the county attorney to ask for an indictment for kidnapping. The police ordered both parties to stay away from each other until further notice. Several weeks later an arrest warrent had not been issued or at least as far as they know. Jane had been in contact with her Dr and is now on medication that seems to be helping. These two are in contact with each other again and getting along.
However...I have a question.
Can the police give a verbal order for Lonny to stay away from Jane without a restraining order? They threatened to arrest him on the spot if he came in contact with her. However neither were given copies of a restraining order.
They cannot afford to retain an attorney at this time.
