What is the name of your state? New York

I had a tenant who move out June 2, 2006. She/he used the security deposit for May's rent. I went into the apt, I found trash and broken furniture everywhere. All the rooms were not clean. (ex.kitchen, bathroom, and bedroom) What can I do? and do I have a good chance to get them to pay for the damages. Help please !!!!!!

RENT SECURITY DEPOSITS

Virtually all leases require tenants to give their landlords a security deposit. The security deposit is usually one month's rent. The landlord must return the security deposit, less any lawful deduction, to the tenant at the end of the lease or within a reasonable time thereafter. A landlord may use the security deposit: (a) as reimbursement for the reasonable cost of repairs beyond normal wear and tear, if the tenant damages the apartment; or (b) as reimbursement for any unpaid rent.


You will have to sue them in small claims court for any damages beyond normal wear and tear .

You have to decide if it's worth it to you , and if you think you can ever collect on a Judgment against them .
