I have been living in an apartment for the last 4 years. This past year, the property was sold. The new landlord has started construction to turn apts. into condos. When I received lease, I "signed" and sent to landlord. (Oct.2000) A few days later, I received an envelope that I thought had the executed lease in it. I simply put the envelope away. Well, I have been living under miserable conditions since November and have documented my complaints to landlord. Specifically, many days of no water or no hot water, apt. door left wide open, workers using my telephone, no closets since December, all of my clothes are just laying around or in boxes. We never know when the workers are coming in to our apartments. All of the tenants have also been notified that they will not be renewing leases as of Oct. 2001. At any rate, I found a house to rent that is perfect. So, I took the envelope with the lease out this week, and neither I nor the landlord ever signed the lease. Can I just give 30 days notice to the landlord? Since I have been paying rent monthly, does that mean I have an unwritten agreement to stay the full year? thank you

As long as you dont have a signed lease, you are month to month so give your 30 day notice and be out by April 30th.

And before you leave take lots of pictures and do a walk thru with the landlord and agree in writing how much of the security they owe you.
