I am considering an offer for a retail store space in midtown Manhattan. It is on the street level (1st Flr) and although it does have a basement, I was told that the basement will not be included in the offer, since the landlord is using it himself for storage.

Is the landlord legally obliged to include the basement in the lease? Being in the retail business, storage space is an absolute necessity.

In addition, if I have already signed the lease agreement, can I still have recourse?

Why did you sign the lease agreement, if the property doesn't suit your needs?

Whatever happens between you and the Landlord over the lease, you will absolutely owe him for his trouble.

You are nothing but a lookie-loo who cannot make a decision and stick to it. Did you sign the lease agreement, or are you just "considering an offer"?

well what is the amount of square footage you are renting?

Figure it out...measure the place, if the sq ft is the same as whats on the lease, then the basement is NOT included, if the sq ft in the lease is a lot higher then what you measured.. then it is.
