My friend got handed a "Writ of Garnishment for Continuing Lien on Earnings" today.
There is a dispute as to the amount the collection agency is claiming is owed. She never received a summons to go to court. Has this been put before a judge without her being there?
Can she request a hearing before her wages are garnished? :confused:

In order to get a garnishment order, the judgment creditor MUST have an existing judgment. She needs to contact the court that issued the garnishment and review her case file.... looking for what is called something like "Notice of Service" (can be different in different states/courts).

Not normally. If she has been properly served and a judgment rendered, the garnishment is likely valid. If not, then she would need to file a motion to dismiss with the original court.
