I am located in Thrall, Texas. My question involves a no trespass order executed by the superintendent of shcools. I was served with a no trespass order by the local police department and when queried about why this order was processed the officer stated that the district did not need a reason to execute the order. My first question pertains to the veracity of this statement. Is a superintendent able to place a no tespass order on anyone at his discretion? Next, this is the entire situation that is going on at this district. Two years ago I filed a Title IX suit against the district for problems in their athletic program. The district, which was about to have a judgement rendered against it due to failure to file paperwork, asked for settlement talks. I agreed and in the settlement talks everything that was being asked in the litigation was agreed to by the district, the only change was I allowd them 2 years to install lighting on a softball field. Now, that occurred in November 2003 and in June 2004 the district terminated the contract of my mother in law, who had worked for the diistrict for about 20 years, then there were several other incidents with my daughter and the softball coach and the athletic director that, in my view, were retaliatory. Also, in this time frame the athletic director made disparaging remarks about my family during coaches meetings and on web bulletin boards. The district refused to pursue any of these incidents even though I made formal complaints on each occasion. Finally, when the AD's contract came up for renewal last year it was not renewed and when it came up for renewal this year it was not renewed in the first meeting and then after a 3 hour closed session was renewed. During this second board meeting I made public comments against the AD and answered statements made at the first board meeting pertaining to this individual. The next day I checked the web bulletin board and the AD had made a disparging remark against my family again and I answered the post and told him to "have some balls and admit who he was", and "if he said one cross word to my son there would be severe consequences". I also emailed the superintendent of the school district and stated the same thing. I have copies of the emails if anyone wants to see them and then I also emailed him to say that I would be stopping by to speak to the AD about his posts. Later that day the superintendent emailed me and said he could meet with me, my wife and my son concerning the situation at 3:00 pm that day. I emailed him back saying my wife and son were not involved with the situation and if I needed to deal with the situation I would address the source of the problem. This is exactly how the district chain of command is constructed and so I felt I was well within my rights to maintain that construction. Two days later I was served with a no trespass order as I stated in the beginning. Now, I have never made a physical threat against anyone at the district and have never presented a physical threat to anyone at the district. In fact my "severe consequences" have always been in the legal realm. So the question is can this superintendent do this or not? Finally, this district is very small (1A in size, 458 total students) in a small town (~500 people) and so in order to register to run for school board or to vote for school board you must go to the administration office to register and you vote in the high school library. So has this person now violated my right to register for election to the school board and has he violated my voting rights since I cannot enter the school grounds without committing a class B misdemeanor? Any information on this is appreciated

My opinion

I would not contact this man. I would simply file a complaint of retalitory behaviors with the state dept. of ed. The sanctions that the district could face are more than you can do with a phone call. In addition, I would look at finding an attorney to file a harrassment (among other things) suit.
