This is a strange question. On Saturday I was pulled head on into a parking space at the mall. The woman next to me was backed into the space. After I got into my car to leave and was backing up the woman next to me pulled my car door open reached in at me and started screaming at me. At first I thought I was being car jacked or robbed. I grabbed the door and slammed it shut adn hit the auto lock button. I yelled for her to get away from my car. She went to the back of my car and refused to move. I asked her several times to move. She claimed I hit her car. a man exiting a store headed toward the cars and ID-ed himself as a policeman and that he would arrest me on the spot if I moved. When I asked for ID he "corrected" himself and noted he was a firepoliceman and fireman. I had all ready called 911, the police arrived asked if we were moving when the vehicles made contact. I told him we were not moving and there was no contact. She then claimed that I hit her drivers door when I got in the car with my door , which was impossible since I was pulled in adn she was backed in. The police said NO ACCIDENT occured, which it didn't . The officer noted a small chalky grey mark about the size of a pencil eraser or smaller on her driver's door...now she has contacted her insurance company who inturn contacted mine. I reported it immediately to them as an "incedent" not an accident since I just knew she was up to something.
Question 1....Is it legal for a firepolice to threaten to arrest me and to Id himself as a policeman?
Question 2...Is there nothing to be done to someone who opens your car door while moving and comes at you aggressively??
Question 3...how do I make sure she does not get my insurance to pay for something I had nothing to do with?
I am just so irritated at her for trying to pull a fast one and don't want her to get away with it and I also don't want my rates to go up because of a false claim.What is the name of your state?

i would let my insurance company handle this one. a good adjustor will be able to prove that your vehicle did or did not make that mark on her car. i had a similiar thing happen to me about a yr and a half ago...adjustor sad there was no way my vehicle did the damage that i was accused of. last i heard of that. i did not have the other part to happen though with the screaming and attempted attacking that you experienced. sounds like what the other person did to you was attempted assault..i would check into that. the woman who attempted to attack you needs to be held responsible for her irresponsible behaviour before she hurts someone. her behaviour was not acceptable to say the least.

The insurance company is supposed to be sending me a form to complete and wants a diagram. I wrote everything down when I came home Saturday so all the minute details were fresh in my mind.
The way she was carrying on and swearing was definately unacceptable but I let her make a noose for herself infront of the policeman. She cursed at him one too may times and told him "the justice system sucked". He told her very matter of factly that if she cursed at him one more time he would "show her the justice system". That in itself was satisfaction enough for me. I told him about her opening my car door and coming at me aggressively, he made note but said nothing further. I was not looking to make trouble and figured she had done enough damage to her reputation infront of the policeman that should anything come of it, he would have made mental note of it as well as written notes.
I just thought I had heard somewhere that opening someones car door is about the same as entering their home with out permission. On the order of breaking and entering or traspassing or something you uhhhh "shouldn't be doing" ...
and the wannabe policeman who turned out to be a fire police ...uhhh doesn't presenting himself and ID-ing himself as a police officer....doesn't that fall under impersonating a police officer? I thought all firepolice could do was report info tothe police, or direct traffic etc during emergencies like fires...but hey let's give any wanna be policeman the authority to threaten law abiding citizens. What do I know? Let's just hope she cooked her own goose and the insurance company does not fall for it.
