What is the name of your state?What is the name of your state?IL.
My mother passed recently from a sudden heart attack
and didn't have a will.My brother and I are the only
beneficiaries. In IL. what is the quickest process to
get the property transferred in my brothers and
my name.I have heard we have to go to Probate court,
and would like to know how the process works.

Depending on the value of your mother's assets (and that includes everything) you may need a probate attorney even if you and your brother are the only 'issues'.

Regardless, your first step is to file probate. Depending on the county in which mom resided, it will usually be located in the county courthouse.

Call the county clerk and ask for the number to the Probate clerk.
