utah: we are being taken to small claims court by a so called friend. my husband and i bought a boat and asked hid brother if he wanted to pay half the payment and in return he would use the boat when he wanted. if he made any damages to the boat ( which there was) he needed to pay for them himself. if he stopped making payments then he lost his right to use the boat. there was no written agreement. his wife in which we have never spoke to about the boat decides she wants to take us to court to get back 2000 dollars she said she paid toward the boat. does she have a case even though we have never spoke to her about this and also can her husband decide that he no longer wants rights to the boat and demand money back?

There's no way to answer you. I guarantee, "hid" brother and wife have a totally different story. Good luck trying to sort it out in front of a judge...ruling will depend on who's version of the agreement meets the common sense test, and the judge's mood that morning.

when will people learn to put agreements in writing!!!????!!!, much less not to sell cars, boats, houses, bikes, etc. to relatives or friends... dumb. just plain dumb.
