Noise from neighbors upstairs

I posted a question about my noisy upstairs neighbors back in Feb. and have since gotten a little girl that I plan to adopt. The problem is that the neighbors upstairs let their two children run all over the apartment dragging and knocking over furniture until late at night. My new daughter goes to bed for school at 8:00 PM and is continuously being wakened by their noise. She comes out of her room crying about not being able to sleep because of the noise.

I have complained at least five times before to the LL. The first time she said that if this could not be worked out, that I would have to move because they had been there first. I can not afford to move, so I stopped complaining. Now that I have my daughter and she cannot sleep, I have complained again. Last night I complained and the noise didn't change for about 45 minutes. Tonight when my daughter came out of her room crying and asked me to make them stop, I called the LL again and she told me that she couldn't get a hold of them last night for 20 minutes so she went up there and they were being very quiet. I guess she was calling me a liar. My daughter asked to talk to her and was crying when she asked her to make them stop. The LL told her to put some cotton in her ears and then hung up on her. The noise did stop soon after that except for the occasional stomp by the mother.

I know that school will be getting out soon, but my daughter will be going to day camp which starts even earlier. This place is advertised as being quiet day and night and a good place to run a home business.

Can anyone tell me what rights I have? I'm at my wits end and cannot afford to move.

Noise from the tenants ( persons themselves ) is a difficult thing to deal with .

If the LL is unwilling to budge , when your time to notify the LL of your move comes up , notify and Move .

I call our City , U-HAUL CITY .

I even went personally to the Mayors Office and spoke to the Deputy Mayor about neighbor Problems . They in turn notified FACIT ( Families in crisis ???? ) Yeah !!!!!

Which the man in turn told me maybe we should move .

Unless they are playing loud music , TV, having Loud Parties ,etc . in violation of Ordnances , don't hold your breath on a solution .
